1. I received a 14-day demand of rent due, what should I do?

It is recommended you attempt to pay prior to the 14-day expiration date. If you are unable to pay by the expiration date a petition for nonpayment of rent will be issued and a court date to attend will be provided.

2. I received a Petition to Court for nonpayment, but I believe my rent is paid, what should I do?

You should contact Collections immediately at 518-641-7496 or via email at collections@albanyhousing.org (Contact through email may receive a more expedited response.) If payment is confirmed, the petition will be withdrawn.

3. I received a Petition to Court, and I can’t pay my rent, what should I do?

NEVER IGNORE A PETITION!!! If you are unable to pay the rent owed, you MUST come to court on the date provided in the notice. At which time we will work with you to determine your eligibility to enter into a repayment arrangement to pay overtime or by a specific time frame. If you are unable to make the court date, you should contact the court office IMMEDIATELY. Failure to show may result in the issuance of an eviction warrant.

4. What if I had an agreement in the past?

The Albany Housing Authority will evaluate whether a family is eligible to enter into a repayment agreement on a case-by-case basis. Agreements will generally be made if you show up for your court date except when one of the following circumstances applies:

  • The family already has a repayment agreement in place; or
  • The family has previously entered into a repayment agreement within the last 12 months; or
  • If the amount owed by the family exceeds the federal or state threshold for criminal prosecution resulting from fraud or related actions.

5. I received a 14-day lockout notice, but I believe my rent is paid, what should I do?

You should contact the Collections department immediately at 518-641-7496 or via email at collections@albanyhousing.org (Contact through email may receive a more expedited response.) to verify if payment was received in full.

If payment has not been paid in full the Collections agent will provide you with options and a list of outside funding sources that may assist with your back rent. You should ACT IMMEDIATELY by contacting them for assistance.

To avoid execution of the lockout, the rent will need to be paid or a commitment from an outside agency must be received prior to the expiration of the 14-day lock-out notice. TIME IS OF THE ESSENCE, NEVER IGNORE THESE NOTICES!!!!


6. What is the cost of being served with a Petition?

The cost of a Petition is $50.00. This fee will be added to the tenant’s account once the petition is given to the process server for delivery.
